Baker's speech failed, in their judgment, to rise to this level. Judge Krupansky, the third member of the panel, dissented. In a sharply worded opinion, he denounced the personal statement majority for compelling the prosecution to meet a standard higher that Congress intended or than the First Amendment required.

In his view, the pertinent inquiry is whether a jury could find that a reasonable recipient of the communication would objectively tend to believe that the speaker was serious about good leadership essay his stated intention.
